OFCOM WRITES TO BROADCASTERS TO ENFORCE THE "INDEPENDENT AUDIT" REQUIREMENTS
During April and May 2009 Ofcom, the UK Television and Radio Regulator, have been writing to broadcasters of all sizes asking them to demonstrate their compliance with Licence conditions that came into force in late 2008.They are being asked to supply details of the independent audits that are meant to have been conducted out by all those running consumer interaction via PRS. This is a core area of expertise for the Enarpee with a number of audits already completed and others currently underway.

0871, 0872, 0873 NUMBER RANGES TO BE REGULATED BY PPP FROM 1st AUGUST 2009
On 5th February 2009 Ofcom announced that PhonepayPlus will regulate all numbers beginning 087, with the exception of 0870, with effect from 1 August 2009, and that these number ranges will formally be recognised as Premium Rate Services. The next 6 months is considered a transition period during which providers of 087x services such as helplines, ticket bookings, road traffic advice lines must ensure they comply with the PhonepayPlus Code of Practice.
In addition, the Code will extend to 09 numbers that are charged at more than five pence per minute (PPM) and less than ten pence PPM.

NEW PRIOR PERMISSION RULES FROM PPP JAN 22 2009
On 21st January 2009 PPP released a statement on Phone Paid service along with new regulations that will primarily affect those subscription services billed via Premium SMS.
Prior permission from PPP and the use of "Double Opt In" (with the user returning a text with the word AGREE), will now be required for all subscription services.
There are two exceptions : those services using PayForIt ( WAP and Web) and Subscription services that cost £4.50 a week or less
Additional rules cover those who send texts regarding another unrelated service - such information should follow the word PROMO or ADVERT. Where appropriate, promotional messages must make it clear that replying will opt the user into a service and information on purchasing phone paid services when browsing on the web should be positioned alongside the description of the service and be sufficiently well communicated that the user can be expected to have seen it prior to any purchase.
